Ultra Vires Zoning: Why I Can Build the large format West Gate Freeway LED Sign

It may interest you all to know that no responsible authority currently holds statutory jurisdiction over Spotswood Trailers land due to the TRZ2 zoning being ultra vires (beyond the powers).

Any compliance action undertaken without this authority is unlawful.

As such — I could literally start construction on a large-format oOh Media-style LED freeway advertising sign and the only thing the authorities could do is watch on, until the pressure on them is so intense to stop construction that the Minister would be forced to act and rezone the property overnight — along with an emergency overlay — hence proving my point that the zoning is both incorrect and unlawful.

But even this requires statutory amendment and public exhibitionAFTER the sign goes up.

No planning permit is needed from Council (they have no jurisdiction over the site), so I could literally start construction on the sign today.

That's how serious the situation truly is.

I have the funds to build it. I have the time. But do I have the courage to actually do it?

Imagine an email from me to the Council and The Department of Transport -

"On such and such date and such and such time I will begin construction on a freeway-facing large format LED sign which will display Bitcoin ads, religious ads from The Zion Church, and other advertising from various fringe groups of my choosing..."

Sheer panic ensues — with public servants scrambling to try and stop me.

You can expect that when this circus ends, the Planning Minister will slap a DDO (Design and Development Overlay) on the property, as well as rezone it to bring it into lawful compliance with the Hobsons Bay Planning Scheme and legal jurisdiction of the Council.
