Planning Checkmate: The Billboard Strategy

Erecting a massive West Gate Freeway-facing LED billboard on my mother’s privately owned TRZ2-zoned land which is directly adjacent to the freeway would send shockwaves through every level of Victorian planning governance — and here's the kicker: I highly suspect that it's 100% legal due to the Department of Transport's zoning mistake.

Day 1 – The Unfolding

A large crane rolls onto the site. Footings are dug. The billboard frame begins to rise. Neighbours look on in disbelief — some thinking VicRoads or Council must be behind it. Phones come out. Social media lights up. Council gets angry calls.

Neighbourhood Reaction

Locals confront me, some aggressively. Others who know the legal story are awestruck. My calmness, my confidence, and the clarity of my legal rights disarm them.

Council Reaction

Result: Council freezes. No enforcement possible.

Consequences

Who Shows Up On Site?

They’ll arrive thinking they have authority. They’ll leave stunned, realizing they don’t.

Why no power/authority?

The extremely rare situation due to the TRZ2 zoning being applied unlawfully on my mother's front block is this:

1. Council has very little power to act or stop me from doing pretty much whatever I want because it's zoned TRZ2 and thats outside the juristiction of council.

2. The Department of Transport has very little power to act or stop me from doing pretty much whatever I want because the zoning is ultra vires as no consent document exists as per ministerial directive clause 23 from The Form and Content of Planning Schemes.

This means that I am effectively running my own de facto planning scheme on the land and I can do this 100% legally because the land is essentially in a "legal no mans land" due to the ultra vires TRZ2 zoning which despite being ultra vires it trumps NRZ5 as the de facto zoning of the block.

There is literally no lawful control over my mother's front block due to the zoning stuff up by The Department of Transport handing a private citizen zoning meant exclusively for Government / The Department of Transport.

The Outcome

This isn’t rebellion — it’s planning history in the making. I’ve exposed a systemic flaw and forced the issue into the open, using nothing but the law, strategy, and the mind of a Computer Scientist applied to an understanding of planning controls and now there's a massive billboard at the end of Cullen Court overlooking the freeway.

It’s checkmate. The Minister is in check. The clock is ticking.

I start dedicating advertising time to special interest causes - like Bitcoin, idiotic friends alien abduction conspiracy theories, religious ads from the Church of Zion around the corner from me because why not, political ads of my own making and other fringe groups ads. Motorists stunned at the sillyness.

Yes this story is ridiculous. But my small scale trailer yard which actually is on the site indicates it's 100% possible!

Obviously - the ministers need to act to rezone the site asap and get it under Council control. We can't have a situation like this continue.

and quite rightly I am doing as much as I possibly can to make sure the site does become appropriately governed by Hobsons Bay Council even though I will lose a lot of power over it by doing so.

And one more thing —

I could have been an independent advertising tycoon, raking in massive profits year after year after year from an LED megasign facing the West Gate Freeway.

The legal pathway was there. The zoning loophole was real. The infrastructure was viable (and the technology moving quickly - Check out YouTube search for "Drone Advertising" The system had no defence.

But I gave it all up.

Not because I couldn’t…

But because I believe my fellow Victorians deserve to have confidence in the integrity of the planning scheme.

I chose lawful civic pressure over personal profit. I chose to expose the flaw — not exploit it. I chose planning reform — not planning warfare.

And that’s why I’m here, openly asking the Ministers to fix the zoning, return proper governance to the land under The Hobsons Bay Council, and close this loophole before someone else walks through it without a conscience.
